This course examines the criminal justice system from the investigation of criminal matters and the arrest of the accused to pre-trial processes and disclosure obligations and from the trial process to the finding of guilt and sentencing submissions. In the context of summary conviction proceedings, students gain insight into the role of the police, Crown prosecutors, and defence counsel and licensed paralegals as advocates for the accused. The course examines the categories of offences, the elements and specific defences of various offences, the charging documents, and judicial interim release of the accused. The various diversion options available and the plea bargaining process are given special attention. The practice and procedure in the summary conviction court are covered, including pre-trial motions, evidentiary presumptions, and sentencing considerations.
