The evolution of tort law, in its partnership with criminal law, is assessed for its effectiveness in compensating victims and deterring wrongdoing. Students examine the various types of intentional torts, including false imprisonment, intentional infliction of mental suffering, and defamation, and their specific defenses. In regard to the law of negligence, special attention is given to the elements of duty of care, causation and foreseeability. Students also gain insight into the various aspects of negligence, analyzing case law relating to occupiers' liability, host liability, vicarious liability, and product liability. The growth in tortious liability is assessed in the context of economic torts, professional liability, and statutory liability. The remedies available in tort law are canvassed, including the principles used in apportioning liability and measuring damages.
