In this course, students will examine the fundamental rules of evidence, including analysis of the rules related to hearsay evidence. Using case studies, students will investigate the scope of evidentiary burdens, privileged communications, and opinion evidence. Students will analyze complex scenarios and apply evidentiary concepts such as materiality and relevance, and similar fact evidence and evidence of habit. Students will practice strategies for the effective presentation of testimonial and documentary evidence in court and tribunal simulations.
