This course covers the rights and remedies of debtors when being pursued by unsecured, secured or preferred creditors, and the rights and remedies of such creditors in collecting unpaid debts. These rights and remedies are examined in the context of secured and unsecured consumer and business loans, outstanding accounts of repairers, storers, contractors and suppliers, defaults under leasing agreements, wrongful dismissal actions, and unpaid wages. The course evaluates the options for debtors under the Bankruptcy and Insolvency Act, the resulting impact on the priority of creditors, and the consequences of fraudulent conveyances or preferences. The unique issues that arise in the collection of lawyers' accounts, in invoking statutory remedies, and in claims against deceased estates receive special attention.
