Academic Year

2016-2017

This course provides in-depth coverage of the dynamics of both pre-trial and trial processes in the Ontario Small Claims Court. Students apply negotiation skills in more fully utilizing the settlement opportunities afforded at the pre-trial conference. In the trial process, the students develop organized advocacy skills to effectively represent their client's case in court proceedings. The interaction of the court agent with witnesses at trial is examined in the context of direct examination, cross-examination, and re-examination. Students will perform a form of duty counsel to assist the public in accessing the court processes. Following judgment, students are introduced to the full selection of enforcement proceedings, and the techniques necessary to maximize collection results. In particular, the scope of the judgment debtor examination is explored, and the important consequences that result from non-compliance with its processes.
